This contract organises the customer\u2019s transportation by the mediation of BERG HAVACILIK from one point to another, which are given in Appendix-A, at the time and price given in Appendix-A again, according to the rules and limitations with regard to the transporter\u2019s responsibilities under the provisions of the domestic and international legislations on passenger transportation.<\/p>\n

  1. \n

    Carriage and other services mediated by BERG HAVACILIK are subject to:
    a) Conditions of carriage
    b) Related regulations of AIR-OPS and SHT-OPS
    c) Provisions contained in this agreement
    d) Applicable route fares
    e) Current laws and regulations in force<\/p>\n<\/li>\n

  2. \n

    Pursuant to the Turkish Civil Aviation Law dated 14th October 1983 and No. 2920, the carriage hereunder is subject to this law and to the rules and limitations relating to liability established by the Warsaw Convention and the Hague Protocol to amend that Convention.<\/p>\n<\/li>\n

  3. \n

    In accordance with the rules relating to Air Taxi Operators of the regulations on Commercial Air Transportation SHY-6A, this agreement constitutes the rental of the complete aircraft indicated in the agreement.<\/p>\n<\/li>\n

  4. \n

    BERG HAVACILIK will make every effort to transport passengers, baggage, or cargo on the date and conditions specified in the agreement. However, BERG HAVACILIK cannot be held responsible for any cancellation or delay due to meteorological conditions, technical conditions, excess baggage, or changes in routes. BERG HAVACILIK retains the right to cancel the flight without any reason, by returning the payment, even though the agreement was signed.<\/p>\n<\/li>\n

  5. \n

    The agreement is only valid for the lessee (institution), route, and dates specified in the agreement and is not transferable.<\/p>\n<\/li>\n

  6. \n

    The fares must be paid before the flight and are non-refundable.
    The following percentages can only be refunded to the customer in case of cancellation before the flight:<\/p>\n

    • \n

      75% of the flight fee in case of cancellation after signing the contract<\/p>\n<\/li>\n

    • \n

      50% of the flight fee in case of cancellation up to 5 days before the flight<\/p>\n<\/li>\n

    • \n

      25% of the flight fee in case of cancellation 8 hours or less before the flight will be paid to the customer
      Any cancellation made by BERG HAVACILIK will be refunded after the flown portion is deducted.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

    • \n

      A person who fails to pass the security checks at airports cannot board the aircraft, and BERG HAVACILIK cannot carry out the transportation even if there is a valid contract. In such case, the flight fee is not refunded.
      The passenger shall comply with all government travel requirements and obey all required restrictions and applications and arrive at the airport half an hour ahead of the departure time or by the time fixed early enough to complete departure procedures.<\/p>\n<\/li>\n

      Articles outlined below shall not be carried in passenger’s baggage without the consent of and agreement with the carrier:<\/p>\n

      • \n

        Compressed gases (flammable, non-flammable, and poisonous)<\/p>\n<\/li>\n

      • \n

        Corrosive materials (such as acids, alkaline, wet batteries)<\/p>\n<\/li>\n

      • \n

        Explosive munitions, fireworks, and flares<\/p>\n<\/li>\n

      • \n

        Flammable liquids and solids<\/p>\n<\/li>\n

      • \n

        Oxidizing materials (such as bleaching powder and peroxides)<\/p>\n<\/li>\n

      • \n

        Poisons<\/p>\n<\/li>\n

      • \n

        Radioactive materials<\/p>\n<\/li>\n

      • \n

        Other restricted articles (such as mercury and magnetized material)<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

      • \n

        Cellular phones, laptop computers, Discman, Walkman, etc., are strictly prohibited to be used during the flight and must be switched off at all times.<\/p>\n<\/li>\n

      • \n

        In round trip routes where flight time is over 2 hours, waiting is free of charge for the same day. In case of remaining overnight (RON), in addition to the crew’s hotel and meal expenses, flight hours are subject to extra payment.<\/p>\n<\/li>\n

      • \n

        BERG HAVACILIK holds the right to refuse carriage to any person who has required a ticket in violation of applicable law or BERG HAVACILIK rules and regulations.<\/p>\n<\/li>\n

      • \n

        No personnel or representative of BERG HAVACILIK has the authority to alter, modify, or waive any provision of this contract. Agreements of this kind will be considered invalid.<\/p>\n<\/li>\n

      • \n

        Anti-Icing\/De-Icing costs will be borne by the customer.<\/p>\n<\/li>\n

      • \n

        War Risk Insurance is not included in the agreed charter price. If an additional War Risk insurance premium occurs at one of the points in the flight schedule, the relevant amount will be extra and invoiced to the customer separately.<\/p>\n<\/li>\n

      • \n

        BERG HAVACILIK strictly refuses to fly to the regions on the European and American sanction lists and to carry passengers who are on the sanction list of the US, UN, EU & UK, Switzerland, Liechtenstein. It is the customer’s legal responsibility to control the passengers on the sanction list and prevent them from boarding.<\/p>\n<\/li>\n<\/ol>\n
